TERMS OF SERVICE
Effective Date: 14 September 2026
Last Updated: 14 September 2026
OVERVIEW
This website is operated by The Warbird Coffee Company Ltd, registered in England and Wales under company number 13113102. Throughout the website, the terms “we”, “us” and “our” refer to The Warbird Coffee Company Ltd.
By visiting our website or purchasing something from us, you use our “Service” and agree to be bound by these Terms of Service, together with any policies referred to or linked from this page. These Terms apply to all users of the website, including visitors and customers.
Please read these Terms carefully before using the website or placing an order. Our online store is hosted by Wix, which provides the ecommerce platform through which we sell our products. Payments are processed securely by Stripe.
SECTION 1 — BUSINESS INFORMATION
This website is operated by The Warbird Coffee Company Ltd, company number 13113102, registered in England and Wales. Our website is www.warbirdcoffeecompany.co.uk and our customer-service email address is sales@warbirdcoffeecompany.com.
SECTION 2 — ONLINE STORE TERMS
You must be legally capable of entering into a binding contract to place an order through our website. If you are under 18, you may use the website and place an order only with the involvement and permission of a parent or legal guardian.
You must provide complete and accurate information when placing an order. You must not use our website or products for any illegal or unauthorised purpose or violate any applicable law, including intellectual-property law.
We may suspend or restrict access to the website where reasonably necessary to protect our customers, our business or the security and proper operation of the website.
SECTION 3 — GENERAL CONDITIONS
You must not use the website for an unlawful or fraudulent purpose, introduce viruses or other harmful material, interfere with its operation or security, attempt to gain unauthorised access to connected systems, collect information about other users without lawful authority, impersonate another person, provide false information or commercially exploit our content without permission.
We reserve the right to refuse or cancel an order for a legitimate reason, including suspected fraud, unlawful activity, product unavailability, payment failure or an inability to deliver to the selected destination. We will not refuse service for an unlawful or discriminatory reason.
The headings used in these Terms are included for convenience only and do not affect their interpretation.
SECTION 4 — ACCURACY AND TIMELINESS OF INFORMATION
We take reasonable care to ensure that the information available on our website is accurate and current. General articles, historical information and blog content are provided for information and interest and should not be treated as professional advice.
Historical material may reflect the information available when it was published. We may correct or update website content when appropriate, but we are not required to update every previously published article. Nothing in this section affects our obligation to provide accurate product, pricing and contractual information.
SECTION 5 — PRODUCTS
We sell roasted coffee, tea, clothing, drinkware and other aviation-inspired merchandise. We take reasonable care to display product descriptions, photographs, ingredients, weights, sizes and colours accurately.
Tea and coffee are natural products and may vary slightly between batches. Packaging and labels may be updated, manufactured or printed products may have minor production variations, and colours may appear differently on different screens. These minor differences do not affect your rights where a product is faulty, materially different from its description or otherwise fails to conform to the contract.
Product images are illustrative unless expressly stated otherwise. All products are subject to availability, and we may change or discontinue products without notice. This will not affect an order that we have already accepted.
SECTION 6 — COFFEE, TEA AND FOOD INFORMATION
Please read all product descriptions, labels, preparation instructions, storage instructions and best-before information before consuming a product. Coffee naturally contains caffeine unless expressly described as decaffeinated, and decaffeinated coffee may still contain a small residual amount of caffeine.
If information displayed online appears to differ from information printed on the product packaging, please contact us before consuming the product. If you have an allergy, intolerance or particular dietary requirement, please contact us before ordering. We cannot guarantee that products have been produced or packed in an entirely allergen-free environment unless we expressly state otherwise.
SECTION 7 — MODIFICATIONS TO PRODUCTS, SERVICES AND PRICES
Product prices and availability may change without notice, but a change will not affect an order that we have already accepted. We may modify, suspend or discontinue part of the website where reasonably necessary.
We are not responsible for temporary website unavailability caused by maintenance, technical problems or circumstances outside our reasonable control. Nothing in this section excludes any responsibility that cannot lawfully be excluded.
SECTION 8 — PRICES
Prices are displayed in pounds sterling and include VAT where applicable. Delivery charges and any other mandatory costs will be displayed before you place your order.
If a product is displayed at an obviously incorrect price, we may reject or cancel the order. If payment has already been taken, we will provide a full refund. Where a pricing error would not have been obvious, we will normally contact you and give you the choice of proceeding at the correct price or cancelling the order.
SECTION 9 — ORDERS AND CONTRACT FORMATION
Your order is an offer to purchase the products shown in your basket. After placing an order, you will receive an automated acknowledgement email. This confirms that we have received the order but does not necessarily mean that we have accepted it.
A legally binding contract is formed when we send an email confirming that your order has been accepted. Please check your order confirmation and contact us promptly if any information is incorrect.
We may decline or cancel an order if a product is unavailable, payment cannot be authorised, the delivery information is incomplete or incorrect, an obvious pricing or description error has occurred, we reasonably suspect fraud or unlawful activity, a stated purchase restriction has been exceeded or we cannot deliver to the selected destination. If we cancel an order after taking payment, we will refund the affected amount.
SECTION 10 — PAYMENT
Payments are processed by Stripe through our Wix ecommerce website. The payment methods available to you will be displayed during checkout. By supplying payment details, you confirm that you are authorised to use the selected payment method.
We do not receive or store your complete payment-card details. Stripe and Wix may process payment information in accordance with their respective terms and privacy notices. Payment will normally be taken when you place your order. We do not charge an additional fee solely because a customer pays using a consumer debit or credit card.
SECTION 11 — BILLING AND DELIVERY INFORMATION
You agree to provide current, complete and accurate billing, contact and delivery information. You are responsible for ensuring that the delivery address entered during checkout is correct and complete, including the correct country, postcode and any required building or unit information.
Please contact us immediately if you notice an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
If a parcel is returned because the customer supplied an incorrect or incomplete address, we may request payment of reasonable redelivery costs. If the order is refunded instead, we may deduct reasonable costs directly caused by the incorrect address where permitted by law. This does not apply where the error was caused by us or the delivery company and does not affect your statutory rights.
SECTION 12 — DISCOUNT CODES AND PROMOTIONS
Unless the terms of a particular promotion state otherwise, only one discount code may be used per order and it must be entered before checkout is completed. Discounts cannot be applied retrospectively or exchanged for cash. Product, customer or geographical restrictions may apply, delivery charges are excluded unless expressly included, and codes will expire on any stated expiry date.
We may withdraw or correct a promotion that has been published in error. We will not normally remove a discount from an order already accepted unless the customer was clearly not entitled to use it or used it fraudulently.
SECTION 13 — DELIVERY DESTINATIONS
Tea and coffee products are currently available for delivery only within the United Kingdom. Merchandise may be available for delivery within the United Kingdom and to selected international destinations.
The destinations available for a particular product will be displayed during checkout. If checkout does not accept a particular country or location, we cannot accept an order for delivery there. We may change the destinations available for future orders.
SECTION 14 — DELIVERY CHARGES AND TIMES
Delivery charges and estimated delivery times will be displayed during checkout. Unless a different period has been agreed, we will deliver your order without undue delay and no later than 30 days after the contract is formed.
Delivery dates are estimates unless we expressly agree that delivery by a particular date is essential. We will contact you if a delay materially affects your order.
SECTION 15 — RISK AND OWNERSHIP
For consumer orders, products remain at our risk until they are delivered to you or to a person you have nominated to receive them. If you appoint a carrier that we did not offer as a delivery option, risk may pass to you when the products are handed to that carrier.
You own the products once we have received payment in full and they have been delivered.
SECTION 16 — MISSING, DAMAGED OR INCORRECT DELIVERIES
Please contact us promptly if your parcel has not arrived within the expected period, the parcel or its contents are damaged, an item is missing or you have received an incorrect product.
We may ask you to provide photographs of the product and packaging to help us investigate. This does not remove or reduce your statutory rights. Our responsibility for delivering an order is not transferred to the delivery company merely because we use a third-party carrier.
SECTION 17 — CANCELLATION RIGHTS
If you are a consumer purchasing online, you will normally have the right to cancel your contract without providing a reason. The cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
If products from the same order are delivered separately, the cancellation period normally begins on the day after the final item or parcel is received.
To cancel, send a clear statement to sales@warbirdcoffeecompany.com confirming that you wish to cancel the order. You may use the model cancellation form at the end of these Terms, but you do not have to. Your cancellation is made in time if you send it before the cancellation period expires.
SECTION 18 — EXCEPTIONS TO CANCELLATION RIGHTS
The statutory change-of-mind cancellation right may not apply to goods liable to deteriorate or expire rapidly, sealed goods that become unsuitable for return for health-protection or hygiene reasons once unsealed, and other goods excluded under applicable consumer legislation.
Opened packets of tea or coffee may not be returned simply because you have changed your mind where a relevant health, hygiene or perishability exception applies. Unopened tea and coffee products are not automatically excluded simply because they are food products. Where no statutory exception applies, the normal cancellation right remains available.
These exceptions do not affect your rights where a product is faulty, unsafe, damaged, incorrectly supplied or not as described.
SECTION 19 — RETURNS
Before returning anything, contact sales@warbirdcoffeecompany.com with your order number. We will provide the appropriate return instructions and return destination. Please do not send products back without first contacting us.
After notifying us that you wish to cancel an eligible order, you must return the relevant products within 14 days. Unless a product is faulty, damaged, incorrectly supplied or not as described, you are responsible for the direct cost of returning it.
Products must be securely packaged. We recommend obtaining proof of postage because the products remain your responsibility until they reach us.
You may inspect merchandise as you would reasonably be allowed to inspect it in a shop. We may reduce a refund to reflect a loss in value caused by handling beyond what was reasonably necessary to establish the product’s nature, characteristics and functioning.
SECTION 20 — REFUNDS
For a valid cancellation, we will refund the price paid for the returned products. Where the entire order is cancelled, we will also refund the cost of our least expensive standard delivery option.
If you selected a more expensive delivery service, we are not required to refund the additional amount above our standard delivery charge. We will not deduct card-processing or administration fees from a statutory cancellation refund.
We may withhold the refund until we receive the returned goods or you provide evidence that they have been sent, whichever occurs first. We will issue the refund without undue delay and normally within 14 days of receiving the goods or evidence that they have been sent.
Refunds will ordinarily be made using the original payment method unless expressly agreed otherwise.
SECTION 21 — FAULTY, DAMAGED OR MISDESCRIBED PRODUCTS
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for any particular purpose made known to us and as described.
If a product does not meet these requirements, you may be entitled to reject it, obtain a repair or replacement, or receive a full or partial refund, depending on the circumstances and the time that has passed. The statutory short-term right to reject faulty goods generally lasts for 30 days.
Where products are faulty, damaged, incorrectly supplied or not as described, we will bear reasonable return costs. Sale and discounted products carry the same statutory rights as full-price products.
Nothing in these Terms replaces, restricts or excludes your statutory rights.
SECTION 22 — INTERNATIONAL MERCHANDISE ORDERS
Only merchandise identified as available for international delivery may be delivered outside the United Kingdom. Tea and coffee products are currently supplied only within the United Kingdom.
International merchandise orders may be subject to import VAT, customs duties, tariffs, brokerage charges or carrier-handling fees imposed by the destination country. Unless checkout expressly states that these charges have been collected in advance, they are not included in the product price or delivery charge. The recipient is responsible for paying them on or before delivery.
We do not control these charges and cannot predict their amount. Customers should check the requirements of the destination country before ordering.
If the recipient refuses to pay applicable import charges and the parcel is returned to us, we may refund the product price after receiving the returned products. Where permitted by law, we may deduct delivery charges that are not legally refundable, return-to-sender charges imposed on us and other reasonable costs arising directly from the refusal.
No refund will be issued until the parcel has been returned to us or the carrier confirms that it cannot be returned. This section does not limit your statutory cancellation rights or our responsibility where products are faulty, incorrectly supplied or not delivered because of our breach.
SECTION 23 — EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, transport disruption, industrial action, natural disasters, war, government restrictions, major network failures or serious disruption affecting our suppliers.
We will take reasonable steps to minimise the effect. If there is a substantial delay, you may be entitled to cancel the affected order and receive a refund for products not supplied.
SECTION 24 — THIRD-PARTY TOOLS, SERVICES AND LINKS
Our website may use or provide access to services operated by third parties, including Wix, Stripe and delivery providers. Third-party services may be subject to separate terms and privacy notices.
Our website may also contain links to websites operated by other organisations. We are not responsible for the content, products, security or privacy practices of websites that we do not own or control.
Nothing in this section excludes our responsibility for fulfilling an order placed directly with us.
SECTION 25 — CUSTOMER REVIEWS AND SUBMISSIONS
If you submit a review, photograph, comment or other material, you confirm that it is truthful and reflects a genuine experience, that you have the right to submit it, that it does not infringe another person’s rights, and that it is not defamatory, unlawful, threatening, abusive, malicious or misleading.
We may moderate or remove material for legitimate reasons, including where it breaches these requirements. We will not knowingly publish, commission or incentivise fake or misleading consumer reviews.
You retain ownership of your content but grant us a non-exclusive, royalty-free licence to display and reproduce it in connection with our website and marketing unless otherwise agreed.
SECTION 26 — PERSONAL INFORMATION
Our handling of personal information is governed by the Privacy Policy and Cookie Policy published on our website.
Our website is provided through Wix and payments are processed by Stripe. Wix, Stripe, delivery companies and other service providers may process information where necessary to operate the website, process payments and fulfil orders.
Please review our Privacy Policy for further information about how personal information is collected, used, retained and shared.
SECTION 27 — ERRORS, INACCURACIES AND OMISSIONS
Our website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, delivery charges or estimated delivery times.
We may correct errors and update information at any time. If an error affects an order that you have already placed, we will contact you where reasonably possible and explain the available options.
Nothing in this section permits us to retrospectively change an accepted consumer contract without a lawful reason.
SECTION 28 — INTELLECTUAL PROPERTY
Unless otherwise stated, our website and its contents, including our branding, photographs, designs, illustrations, text, videos and product artwork, belong to us or are used under licence.
You may use the website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify, sell or commercially exploit our content without prior written permission.
Purchasing a product does not transfer ownership of any copyright, trade mark or other intellectual-property rights appearing on that product.
SECTION 29 — OUR RESPONSIBILITY TO CONSUMERS
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen or if both parties knew that it might happen when the contract was formed.
We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights relating to goods, and defective products where liability cannot legally be excluded.
Our products are supplied for private and domestic use. We are not responsible for business losses such as loss of profit, revenue, opportunity or business interruption where products are used for commercial purposes.
SECTION 30 — COMPLAINTS
If you are unhappy with a product or our service, please contact sales@warbirdcoffeecompany.com and provide your name, order number and a description of the problem.
We will acknowledge and investigate complaints within a reasonable period. Independent consumer advice is available from Citizens Advice.
SECTION 31 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our business, website, products or applicable law.
The Terms in force when your order was accepted will normally govern that order. We will not retrospectively change an existing consumer contract without a lawful reason.
The latest version and its effective date will be displayed on this page.
SECTION 32 — SEVERABILITY AND WAIVER
If any provision of these Terms is found to be unlawful or unenforceable, it will be treated as removed or modified only to the extent necessary. The remaining provisions will continue in effect.
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
SECTION 33 — ENTIRE AGREEMENT
These Terms, together with the relevant product description, order confirmation and policies expressly referred to within them, form the agreement between you and us concerning your order.
Nothing in this section excludes liability for fraud or prevents a consumer from relying on statements that legally form part of the contract.
SECTION 34 — THIRD-PARTY RIGHTS
Unless expressly stated otherwise, no person other than you and us has a right to enforce the contract under the Contracts (Rights of Third Parties) Act 1999.
SECTION 35 — GOVERNING LAW
These Terms and any contracts formed under them are governed by the laws of England and Wales.
If you are a consumer living in Scotland or Northern Ireland, you retain the benefit of any mandatory legal protections applicable where you live. Consumers may bring legal proceedings in the courts of the part of the United Kingdom in which they live.
SECTION 36 — CONTACT INFORMATION
Questions about these Terms, orders, cancellations, returns or complaints should be sent to admin@warbirdcoffeecompany.com
